Call the Board Of Cosmetology in your state and ask them. In Louisiana, we have a "makeup permit" that can be obtained from attended a couple different academies. Most states aren't like that though I'm pretty sure. Being a cosmetologist or an esti usually means you are automatically legal to do makeup. Your best bet is to call the board, specifically ask for the person over makeup, and ask them.

You don't need a license to be a makeup artist. But it really helps to go to school to have an easier time building a network and building confidence in your craft.
