Almost every household item you can name tests on animals. Almost all medicines are tested on animals. I wouldn't discourage a product just because of testing on animals.
As for the question, I'd recommend badgal lash, I forget who it's by though. I love the brush.

Badgal is also by benefit. As far as a matte black and smoky mascara I really really love Mac 3d black lash. it gives great volume and separation, doesn't smudge, and is super matte.

Loreal Power Volume 24hr Mascara in Black Smoke is absolutely amazing. It's matte, very voluminous, and doesn't clump! I definitely recommend it.

It's never a bad idea to inform people who tests on animals :) you can't discredit those who avoid cruelty free makeup simply because they haven't found alternatives in other parts of their lives. If a fireman didn't save anyone because "well we can't save them ALL" the world would kinda suck.

I love They're Real by Benefit Cosmetics but for me it's actually more lengthening than volumizing. I love Too Faced's Better Than Sex or for a cheaper option Maybelliene's Lash Discovery (it's a mini-brush)
